Conditions:

11. No development shall commence until full details of the hard landscaping works,
including phasing proposals for that phase, have been submitted to and
approved in writing by the local planning authority and these works shall be
implemented in accordance with the approved details and phasing unless
otherwise agreed in writing by the local planning authority.
The hard landscaping
details shall include proposed finished ground levels or contours; means of
enclosure; car parking layout; other vehicle and pedestrian access and circulation
areas; and hard surfacing materials and finishes, minor artefacts and structures
(e.g. furniture, public art, refuse or other storage units, proposed and existing
functional services above and below ground (e.g. drainage, power,
communications cables, pipelines etc. indicating lines, manholes, supports etc.)
Reason: In the interests of visual amenity and to protect the character and
significance of heritage assets in accordance with polices 2 and 23 of the
Cornwall Local Plan (2016) and the aims and objectives of paragraphs 58 and
131 of the National Planning Policy Framework.

12. No development shall commence until full details of soft landscape works,
including a phasing plan and implementation plan have been submitted to and
approved in writing by the local planning authority and these works shall be
carried out in accordance with the approved details and phasing and
implementation plans.
The soft landscape details shall include planting plans;
written specifications; schedules of plants noting species, plant sizes and
proposed numbers and densities. All soft landscape works shall be carried out in
full accordance with the approved details. Any trees or plants which within a
period of five years from the completion of the development die, are removed or
become seriously damaged or diseased shall be replaced in the next planting
season with others of a similar size and species.
Reason: In the interests of visual and residential amenity and in accordance with
polices 2 and 23 of the Cornwall Local Plan (2016) paragraph 58 of the National
Planning Policy Framework.

Planning Permission PA16/03519: Discharge of Condition Nos. 11 & 12

On behalf of our client, Cranford Developments Limited, we are instructed to submit the following information to
secure discharge of conditions nos. 11 & 12 of the above consent:

» Drawing AAJ4932-RPS-XX-EX-DR-L-LSO1E, Detailed Landscaping Proposals Sheet 1 of 3;

e Drawing AAJ4932-RPS-XX-EX-DR-L-LSO2E, Detailed Landscaping Proposals Sheet 2 of 3;

» Drawing AAJ4932-RPS-XX-EX-DR-L-LSO3E, Detailed Landscaping Proposals Sheet 3 of 3, Planting Schedule
and Specification.

The two conditions preclude a commencement on site until details of the hard landscaping (condition 11) and
the soft landscaping (condition 12) have been approved by the Council.

The details shown on above drawings address these matters and, as such, we trust they are sufficient to enable
discharge of the conditions.

Our client wants to be in a position where it can lawfully commence its development. We are therefore
submitting the necessary information required to discharge all pre-commencement conditions on Planning
Consent PA16/03519.

That said we are aware that Cornwall Council and CORMAC are proposing to carry out highway enhancement
works on the A30 at Loggans Moor Roundabout (the ‘Council's Hignway Works’) with construction due to start in
2020/21. The Council's Highway Works are different to and are likely to supersede the highway works approved
as part of our client's planning consent, PA16/03519.

Should it become apparent that, as a consequence of the Council's Highway Works, the landscaping details
submitted as part of this application require amendment or change at a later date such an amendment could
and would be sought either as a revised submission of details application or by way of a Section 73 application.

Until that position is known however our client is proceeding on the basis of the works outlined in its existing
consent.

 

Our client has not yet appointed a Principal Contractor to carry out the Hayle Retail Park development. The pre-
commencement information submitted reflects this but is sufficiently detailed to enable you to discharge the
related Conditions.

We confirm that all approved pre-commencement details will be supplied to tendering parties within a tender
information Dack in due course.
